Compensation for Adults Disabled Since Childhood

The Social Security Administration has created a program to pay benefits for adults who have been disabled since childhood.  Social Security Disability Insurance (SSDI) benefits are available for people who were disabled before they turned 22 years of age or received dependents benefits on a parent’s Social Security earnings record before the age of 18.  These benefits will be paid as long as the adult remains disabled.

The SSDI benefit for adults disabled since childhood is considered a “child” benefit because it goes on the parent’s Social Security earnings record.  In order to qualify, one or more of the disabled adult’s parents must be receiving Social Security retirement or disability benefits or have died, but worked long enough under Social Security.

Approving a disabled adult under the “child” benefit is treated the same way as any disabled adult.  The New York Disability Determination Services will be given the task of approving SSDI benefits based on the disabled adult’s medical condition.  The application process for a disabled adult includes the same steps as a disabled child.  For example, detailed information about the condition must be provided, along with dates of doctor and hospital visits.  A question will be asked regarding the impact the disability has on the adult’s way of life.

The application process can be complex and it generally takes a few months to get an approval.  Sometimes applications for SSDI benefits are denied.  In that situation, a knowledgeable New York Social Security Disability attorney can step in to work on an appeal.  Even if a Social Security Disability Insurance application is denied, it is possible to later receive an approval.  The attorneys at Markhoff & Mittman, P.C. have extensive experience in handling Social Security Disability denials.  Call (866) 205-2415 for a legal consultation.
