More Limitations on Injured New York Workers? Yup, It's True

Earlier this month, the New York State Worker's Compensation Board limited the amount of treatments a worker's compensation insurance will cover. Medical experts, including the President of the Physical Therapy Alliance of Upstate New York even offered a press release to lament the hindrance the limitations would cause injured workers. Patrick Privatera said essentially expressed his belief that the limitations would not provide adequate treatment for patients in need.

The Worker's Compensation Board believes that the new regulations would help cut costs of the compensation system as well as improve the quality of care for injured workers. We can understand the financial aspects of their actions but how less care improves the quality of care is still a bit confusing.

For workers who can not get better due to lack of treatment, how are they expected to return to work? And if said employees do return to work, how can they afford to live if they have to fork over their paychecks to cover medical bills they still need to improve their recovery from injury? Seems kind of illogical at best.

Different on the job injuries required different treatments so those who are unfortunate enough to injure their back, spine, or neck may not be entitled to full recovery costs as their counterparts who sustained less serious injuries to arms, legs, or knees. While there are different treatment courses allowed for different injuries and body parts, it still seems unfair that those New York injured workers with tougher issues can be cut off before they have had success.

This is one reason you need to make sure you know your employee rights. With an on the job injury, things can get complicated and losing your options means losing your family's income. You need the legal protection to ensure you truly get what you need to recover from being hurt at work, even if that means additional funds to cover ongoing medical and physical treatments.
