OSHA and Workers Compensation: Helping Workers Before and After An Accident

As an employee you may or may not be familiar with the role OSHA plays in providing a safe working environment. Depending on your type of work, you may have heard of OSHA (Occupational Safety & Health Administration) but are unfamiliar with what exactly this organization does. OSHA sets forth rules and regulations which every company under federal jurisdiction must follow to ensure all employees have a safe environment in which to work. Their role is an important one to keep employers in check when it comes to providing a work environment which is free from hazards that may result in injury or even death.

How Does OSHA Help Keep Workers Safe?

Despite the regulations on the books, thousands of workers continue to suffer from injuries at the workplace each year. That number would be much higher of course without the standards established and enforced by OSHA. Unfortunately there are situations where an employee intentionally or unknowingly puts their employees at risk due to unsafe working conditions. When OSHA rules have been violated employers risk penalties and fines that could very well put them out of business. Sadly these actions come too late for the injured worker.

What Role Does Workers Compensation Play?

When an accident happens at work, regardless of who is at fault, workers compensation insurance provides the coverage necessary to pay for medical expenses and lost wages. Workers compensation is not in place to penalize either the worker or the employer for events leading up to the accident. While many workers compensation claims are cut and dry, with no question as to whether or not the employee is entitled to benefits, other claims fall into a "gray" area. With so many workers filing fraudulent claims, it is not uncommon for injured workers to experience some problems with their workers compensation claim. Fortunately, experienced workers compensation attorneys have the training and expertise to help ensure your claim is taken seriously.
