Stroke from a head injury, worker entitled to benefits

John B. was struck in the head by a tree branch while attending a company sponsored golf outing. As a result of that injury, he suffered a stroke (cardiovascular incident) two months after the initial head injury. The insurance company hotly contested John B.'s right to receive workers compensation benefits, claiming that the traumatic head injury did not cause or even contribute to the stroke.

Testimony was taken from the injured worker's treating doctor, the insurance companies paid consultant and an "Impartial Specialist" from the New York Workers Compensation Board.

After numerous appeals, John B. was awarded retroactive benefits (over $65,000) and ongoing benefits, including medical care. He was also found to be Permanently Totally Disabled.

Awarded: Permanent Total Disability
