If I hire an attorney to handle my Social Security Disability case, how does my attorney get paid?

 

A: If you hire an attorney to settle your social security disability case, you do NOT pay upfront and you should NOT have any out-of-pocket expenses. 

Your attorney is entitled to get 25% of any past due benefits up to a maximum of $6,000.  When you hire an attorney, you enter into a fee agreement which must be approved by the Social Security Administration (SSA).  The fees are set by the SSA and the federal government. Upon winning your case, the SSA will generally pay your attorney directly.  As with anything, ocassionally mistakes are made - if that was the case you'd be required to submit payment.
