New Medical Treatment Guidelines for New York Workers’ Comp – Clear as Mud?

If you are currently receiving treatment for a workplace injury in New York, you need to know about the new Medical Treatment Guidelines released by the New York Workers’ Comp Board (NYWCB). This means that the way you’ve been receiving treatment for your neck, mid and lower back, shoulder or knee injury could be changing.

  • Important note: these new medical treatment guidelines apply only to the neck, mid and low back, shoulder and knee. These guidelines do not apply to any other body parts like elbows, hands, hips, ankles, or feet.

What do the NY medical treatment guidelines include?

If you are getting treatment for or will be getting treatment for a neck, back, shoulder or knee injury, this is the type of information that is published in the treatment guidelines:

  • General medical guidelines
  • Treatment time frames
  • Procedures or treatments that are NOT recommended
  • Guidelines on treatments that should be used
  • Guidelines for returning to work
  • Medical history and physical exam guidelines
  • Diagnostic and imaging tests that are permitted
  • Surgical approaches that are allowed
  • Follow-up requirements
  • Maximum duration and frequency for your treatments
  • Medication use guidelines

If this seems like a lot of information, it is! The guideline document for an on-the-job neck injury in NY, for example, is 72 pages long. In addition, there are over 70 frequently asked questions about these new medical treatment guidelines on the New York Workers’ Compensation Board website.
