Limitations on Attorney Fees for The Zadroga Act Victim Compensation Fund

The Zadroga Act gives many responders on the scene during the 9/11 attacks a second chance. For individuals who didn't get sick from the effects of 9/11 until after the original Victims Compensation Fund was closed, or became ineligible, they can now apply for monetary compensation for the damages they endured.

When the Victim Compensation Fund was modified by The Zadroga Act, it included a limitation on the amount of money an attorney could charge for individuals making claims. The cap on attorney fees is no more than 10% of awards made on a Zadroga Act claim.

The Zadroga Act also prevents "double dipping" by attorneys who have already represented ten thousand 9/11 responders in New York. If you were already part of the original Victim Compensation Fund and have paid an attorney fees for representing you or as part of a civil action, the new attorney fees are limited to a total of 10% of the aggregate amount awarded previously. If you have already paid attorney fees greater than 10% of your award amount, the attorney cannot charge an additional fee under The Zadroga Act for additional services.
