NY Cancer Victims Can Apply for Social Security Disability Benefits

Unfortunately, cancer is a relatively common and sometimes debilitating medical condition that can leave New York employees unable to work the way they used to. If your cancer is malignant and is preventing you from working and providing for your family, you may be able to receive Social Security Disability benefits.

Not all cancer patients are eligible for disability benefits. Your cancer disability must be severe enough to sharply limit your ability to work. You would have to prove that you have the following limitations because of your cancer:

Physical limitations: unable to stand, sit, lift, push, or engage in other physical activity necessary for your job. Or, you may be unable to see, hear or speak because of the cancer.
Cognitive limitations: unable to understand instructions, follow instructions, remember tasks, handle changes in the work environment, interact with coworkers.

You also cannot be bringing in a significant income if you want to receive disability benefits. If you are unable to work or if you are unable to make more than $1000 a month working because of your cancer, you may be eligible. The SSA will investigate whether or not there is work you could be doing despite your condition.

You will need a doctor’s report to show the location of your cancer, the type of cancer, and whether or not it has spread (distant metastases). Your age may also be a factor in the determination.
