Factors that could affect your Social Security Disability Claim

Completing an application for Social Security Disability benefits can be a daunting experience. There are so many details to keep track of and so much paperwork to fill out. Not only that, but there is a long wait time for a decision – applicants can wait months to find out if their application has been approved.

Given the difficulty that many applicants face when applying for SSD benefits, you want to make sure that you’ve been very careful with your application. There are some factors that could affect your SSD benefits application, factors that you should let the Social Security Administration know about.

Outstanding warrants

If you have an outstanding warrant for your arrest, you’ll need to inform the SSA if the warrant is for a felony in the state where you live or if the warrant is for a crime that can be punishable by death or imprisonment for more than one year if your home state does not classify crimes as felonies.

The SSA needs to know about these types of warrants because you are not eligible to receive benefits for the period of time that you have an outstanding arrest warrant. If you fail to inform the SSA and receive benefits when you aren’t supposed to get them, you may have to pay them back if you are caught.

Criminal conviction

If you are convicted of a crime, you must inform SSA. You may not be eligible to receive SSD benefits for the months that you are confined for a crime, however if you have family members eligible for benefits because of you they may be able to continue receiving them.

You may be ineligible to receive benefits if you commit a crime and are confined to an institution by court order because you were found guilty by reason of insanity or because you were judged incompetent to stand trial.

Parole or probation violations

You must tell SSA if you violate a condition of parole or probation that was imposed on you under federal or state law, because you are not eligible to receive benefits for the months during which you violated any conditions.
