Accident Involving Skydiving Plane Could Lead To Workers' Comp Claim

Posted on Aug 02, 2010

Workers' compensation cases often involve routine activities gone awry, but if any employees of a local skydiving outfit near Buffalo decide to make a claim, it will be the result of a terrifying crash.
As with many aircraft accidents, this one occurred on takeoff, when the six-seater failed to make it skyward and crashed into trees before ending up on the ground. All of the occupants were hospitalized, although reports indicate that the pilot was walking around safely.
Although weather was not likely to play a factor in the crash with sunny skies and no wind, the investigation of the crash is still ongoing and authorities have not released any preliminary findings about the role of Frontier Skydivers, the company running the flight.
But it's also clearly a sign that people who work in the leisure sector can also risk their safety in the course of doing their work. Skydiving instructors and pilots who work full-time are eligible for workers' compensation benefits if they're injured, like the occupants in the recent plane crash. The owner of the business is also responsible for maintenance of the plane and providing a safe work environment.
Whether or not they do is another story. We've previously noted that employees may be less likely to report a claim because of pressure from their bosses or a lack of understanding about the process. If you've been injured and want to learn more about how to apply for benefits, contact Markhoff & Mittman, P.C. today.
