Brooklyn Contractor Cited By OSHA for Fatal Worker Fall

Roth Metal Works, a steel erection contractor in Brooklyn, has received a citation by the US Department of Labor's Occupational Safety and Health Administration (OSHA) for a fatal fall that too place on a Brooklyn construction site.

Roth Metal Works employees were conducting steel erection work on a residential building when an employee working to connect a steel beam to create a balcony when a steel beam he was on shifted. The worker fell roughly 50 feet to the ground below. The fall proved fatal.

OSHA conducted an inspection and found that the beams on the sixth-floor level had not been stabilized, leaving workers susceptible to steel collapses and falls. Construction workers were also found to lack protection from potential falls as scaffolding was found to lack cross-bracing. Additionally access to the scaffolding had not been erected or moved under the direct supervision of a competent person.

Roth will face an OSHA citation for alleged willful and serious violations of workplace safety standards. They received one willful citation for failure to stabilize steel beams and four serious citations for failing to have fall protection and scaffold hazards for their workers. Roth faces $45,750 in proposed fines and has 15 business days from the receipt of the citations to meet with the area director of OSHA. They may also contest the citations and penalties before the OSHA Review Commission.

Under the Occupational Safety and Health Act of 1970, employees are responsible for providing safe and healthful workplaces for their employees. OSHA sets and enforces standards, provides training, assistance, and education for protecting American workers. The citation for willful violations means Roth showed voluntary disregard or plain indifference to the health and safety of its workers.
