Ex-NFL player wins workers’ comp ruling

According to an appellate division of the New York Supreme Court, Thomas Lynch, a former NFL player for the Buffalo Bills, will be able to receive workers’ compensation benefits from the Special Fund for Reopened Cases.

Lynch was injured in 1984 and suffered what was classified as a permanent partial disability. He received compensation for his injuries until 2001 when benefits were suspended because he earned more than his previous wages as a player.

Lynch disagreed with the suspension, arguing that his higher wage did not last therefore he was entitled to receive additional benefits. His application requested workers’ comp benefits for the period between January 1, 2003 and January 1, 2006.

The NY workers’ comp board upheld a decision by a workers’ comp law judge that split Lynch’s claim between the Buffalo Bills and the Special Fund. However, the Special Fund appealed the decision.

The ruling was affirmed by Albany-based appellate division Judge McCarthy.
