Injured Workers - A Look at Wage Earning Capacity

Work Comp Central announced today that groups representing both NY unions and claimants' attorneys presented a joint set of recommendations to Gov. Paterson and workers' comp officials - Together, the groups want to break the impasse over the state's proposed impairment guides. Ultimately, how will wage-earning capacity be determined for those injured on the job? The recommendations suggest the state use a grid approach to determine loss of wage-earning capacity based on a variety of factors including functional impairment, age, skill level and education.
