According to the Westchester County District Attorney’s office a doctor with a practice in New Rochelle has violated workers’ comp law in helping a former Sing Sing correctional officer defraud the New York workers’ comp fund.
The doctor, Dr. Michael Palmieri, 46, was arraigned on felony charges of third-degree grand larceny and fraudulent practice. He is accused of helping the former corrections officer Leo Coletti file false injury claims between March 1, 2004 and April 8, 2006.
As a result of the false claims Coletti bilked the compensation fund out of $40,170. He was able to perpetrate the fraud thanks to Dr. Palmieri, who is accused of preparing and presenting false injury claims for Coletti.
The false reports claim that Coletti was unable to work at all because of his work-related injuries. However, at the time Coletti had a general contracting and home-renovation business. Prosecutors claim that Coletti was, in fact, renovating the doctor’s home and office.
As a result of the case Palmieri faces up to seven years of jail in state prison due to the charge of larceny. He was released without bail and will return to court towards the end of June.
