NY couple arrested for cashing deceased father’s workers’ comp checks

The New York State Insurance Department has announced that a man in Saratoga County is in hot water after he and his wife cashed their deceased father’s New York workers’ compensation checks. 

 

The NY State Insurance Department’s Fraud Bureau began an investigation into the matter after being notified by Crum & Forster Indemnity Company, the workers’ comp insurer.  The insurer had performed a routine audit, and noted suspicious activity in the deceased man’s case.

 

The audit revealed that the man entitled to receive the checks had died, however he was still being sent checks – that were being cashed by somebody.

 

The father passed away in September 2008, however his workers’ compensation checks continued to be sent.  His son, Geoffrey Gabel, 40, and his wife, Kelly Gabel, 38, from Mechanicsville, cashed the checks.  It is estimated that the pair stole $13,000 from the insurer by cashing the deceased man’s checks.

 

The pair were charged with third-degree grand larceny after their arrest.  They will appear in a hearing in the Albany County Court, and they could be sentenced to seven years in prison.
