NY employers responsible for $133 million needed to cover workers’ comp claims

The failure of a Bermuda-based company that managed a number of workers’ comp insurance funds has left about 2,000 New York companies to foot the bill for unfunded workers’ compensation claims.

 

According to the New York State Workers’ Compensation Board, the company, CRM, insured the companies under a collection of group trusts, but the companies were left high and dry when the funds collapsed.

 

Last year the Workers’ Comp Board took over several CRM self-insurance trusts, leading CRM to surrender their third-party administrator license in New York.  CRM claims it was a victim of economic conditions and did nothing wrong.

 

According to state regulators, CRM did not pay all the workers’ compensation claims it should have and also failed to maintain enough funds on hand to cover future claims.

 

The 2,000 or so NY companies are on the hook for $133 million to cover the unfunded workers’ compensation claims.  Each company has been billed an average of $74,000 and all will share in the responsibility for future compensation claims.
