NY man accused of workers’ comp fraud

A New York worker has been accused of collecting workers’ comp benefits from the New York State Insurance Fund for more than a year after he returned to work.  The man, William P. Franz Jr., 30, was arrested and faces charges on multiple felonies.

 

The felony charges Franz faces include offering a false instrument for filing, insurance fraud, grand larceny, perjury, and violating the Workers’ Compensation Law.  Franz submitted signed paperwork to the insurance fund claiming that he had not returned to any form of work since sustaining the injury.

 

Franz was injured in 2004 when he fractured his foot while working as a worker for a remodeling company.  About a year ago he returned to work as a roofing subcontractor for a general contracting firm, but continued to collect workers’ comp benefits.

 

According to investigators Franz collected over $6,000 in wage replacement benefits that he should not have.  Franz was considered to have a permanent partial disability because of his injury, and the state insurance fund could have paid him over $300,000 over the life of his claim if had not been caught.
