NY State Workers’ Comp Rules Out of Date, Inadequate

The co-chairman of the New York State Trial Lawyers Association stated that the workers’ comp laws in New York are out-of-date and badly in need of reform.  Not only is reform needed for the inadequate and confusing system, but it is difficult for some state workers to figure out how to get compensation for on-the-job injuries.

 

Workers’ comp rules are so confusing that many injured workers need an attorney to help them file for benefits.  Workers who try to “go it alone” are often left without necessary aid and may waste time trying to apply for compensation properly.

 

After a revealing investigation of the New York workers’ comp system by the New York Times last month, the comments are no surprise.  Workers face a maze of confusing laws and policies, fraudulent and bullying employers, dishonest doctors, and a system biased against them.

 

Workers can also be confused as to whether they are covered by workers’ comp insurance through their employer or if their injures fall under union programs.  State employees can be especially confused, with rules for some state employees differing from rules for others.
