NYC security firm settles workers’ compensation discrimination probe

Posted on Feb 18, 2009

The New York State Attorney General Andrew Cuomo has reached an agreement with Guardsmark, LLC to settle a discrimination investigation.  Guardsmark, the nations’ fifth-largest security firm, was accused of discriminating against potential employees with disabilities or those who have previously received workers’ compensation benefits.

The investigation was started when the Attorney General’s office received complaints that the Guardsmark application process was discriminatory.  The Attorney General found that some questions on the Guardsmark application directly violated federal or state law.  The application also asked for information that could be used to discriminate against applicants, which also is a violation of the law.

In addition, Guardsmark will have to pay $110,000 to New York State to resolve the investigation.
