The Department of Transportation workers who have been resurfacing Forest Hill Road in Willowbrook say that they are always in danger because drivers don't respect work zones. In fact, on a recent Tuesday, a man driving a truck sped into the work zone in an attempt to get ahead in traffic and crashed through the safety barrels marking the site. The workers tried to chase the man down after he endangered their lives, but they were unable to identify him. The next day, the very same driver made the same attempt to save a few minutes, but ended up with a safety barrel under his truck, ultimately resulting in a collision with another vehicle. He then fled the scene, and it is unlikely that a case will be brought against him. One Willowbrook worker said, "We have to watch our backs all the time."
New York transportation workers recount stories of angry drivers throwing coffee cups, yelling, cursing, and driving dangerously. Some workers sadly recall coworkers who were injured or killed on New York worksites. They can't help wondering who might be next.
Under New York law, the truck driver did not commit an illegal act by entering the work zone, and that's why DOT workers want to see legislation passed that would make intrusion in an active work zone a misdemeanor with a large fine and potential three-month jail sentence. This legislation passed the New York Senate recently, and workers feel it is a step in the right direction for their safety on worksites.
As Bronx workers' compensation lawyers, we have seen a lot of injured transportation workers over the years. We want to remind everyone to SLOW DOWN and BE AWARE in work zones.
