Mindy Berger, a 38 year old Kingston woman was sentenced to 30 days in jail for enabling an inmate to continue to receive workers' comp benefits while serving time in Ulster County jail. Berger faces 30 days in prison, five years probation and must reimburse the New York State Insurance Fund $300.
Berger was arrested for fraud after investigators discovered she was providing false information on work status reports - stating that the individual, whose name is not available as of this time, was not serving a jail sentence. She forged the inmates signature as well. State law mandates that inmates are prohibited from continuing to receive any workers' comp benefits they might have been receiving prior to serving a jail sentence. According to reports, the individual had been receiving benefits as a result of a job-related injury.
